This arrest over WhatsApp messages that read like jokes or meme-based commentary shows how easily protected speech can be miscast as criminal “threats.”

To prosecute Saldana, it must be proven that she knew her messages could be perceived as threatening and sent them anyway.

The bar is high for a reason. Law enforcement should be very careful before turning informal group chat banter into criminal charges.

Protected speech cannot be treated as a crime simply because it is offensive, poorly worded, or misinterpreted. Jokes are not true threats and shouldn’t land someone in jail.
